WNBC.com first reported how Green was left for hours on the emergency room floor as security guards, a doctor and nurses walked past her. The videotape first aired on News 4 New York shocked the city. The New York Civil Liberties Union said the tape highlighted years of neglect of patients inside the facility.

When asked for an update on the case, a spokeswoman for DOI said, "The investigation is ongoing."

Numerous hospital staffers were immediately fired when the videotape surfaced. Green's relatives want some hospital workers held criminally responsible for her death including allegations that medical records were doctored to try to cover up the neglect.

Sanford Rubenstein, an attorney for the family, said the children want to meet with DOI investigators to try to find out if there are plans to ask the Brooklyn District Attorney to present the case to a grand jury.
